Dwellera policies
Terms of Service
These terms explain the rules for using Dwellera.
Effective date: September 10, 2026
By creating an account, accessing the authenticated Dwellera service, or otherwise using Dwellera, you agree to these Terms of Service and acknowledge the Dwellera Privacy Policy.
If you do not agree to these Terms, do not use Dwellera.
1. Eligibility
You must be at least 18 years old and legally able to enter into a binding agreement to create or use a Dwellera account.
Dwellera is intended for adults managing home and household information and is not designed or directed as a service for children.
By using Dwellera, you represent that you meet these eligibility requirements.
2. The Dwellera service
Dwellera is a home-information organization and recordkeeping service.
Depending on the features available to your account, Dwellera may allow you to:
- record information about a home;
- track systems and appliances;
- maintain service and maintenance history;
- create maintenance reminders;
- store documents and photos;
- search supported home information;
- export supported home information;
- archive a former home and preserve its history; and
- manage related account and home-access settings.
Dwellera may change, add, remove, suspend, or discontinue features over time.
Unless expressly stated otherwise, Dwellera does not guarantee that any particular feature will remain available indefinitely.
3. Your account
You are responsible for maintaining accurate account information and for using your account in accordance with these Terms.
You are responsible for safeguarding access to your account and authentication credentials.
You must not:
- share credentials in a manner that allows unauthorized account access;
- permit another person to impersonate you;
- attempt to gain access to another user's account or information without authorization; or
- use another person's credentials without permission.
You are responsible for activity performed through your account to the extent permitted by applicable law.
If you believe your account or credentials have been compromised, contact Dwellera promptly.
4. Home access and permissions
Dwellera may allow an authorized user to grant another person access to home information.
Access may be assigned according to roles or permission levels such as owner, editor, or viewer.
The capabilities associated with a role may differ depending on the Dwellera feature involved.
You are responsible for deciding whom you authorize to access your home information and what access level you grant.
Before granting access, you should consider the information, documents, photos, and other records stored in the home.
You must not grant access to another person's information unless you have the authority or permission necessary to do so.
Revoking Dwellera access prevents future access through the service, but Dwellera cannot retrieve or erase copies that another authorized person previously downloaded, exported, photographed, copied, or otherwise retained outside Dwellera.
5. Your content
You retain your rights in the information, documents, photographs, and other content you provide to Dwellera.
Dwellera does not claim ownership of your user-provided content.
By providing content to Dwellera, you grant Dwellera a limited, non-exclusive license to host, store, process, reproduce, display, secure, back up, export, transmit, and otherwise handle that content only as reasonably necessary to provide, maintain, protect, and operate the service.
This license does not give Dwellera ownership of your content.
You are responsible for ensuring that you have the necessary rights or permission to provide content to Dwellera.
6. Your responsibilities
You are responsible for the information and content you enter, upload, maintain, or share through Dwellera.
You agree not to use Dwellera to:
- violate applicable law;
- infringe another person's rights;
- upload or distribute malware or other harmful code;
- attempt unauthorized access to Dwellera systems or another user's information;
- bypass or interfere with authentication, authorization, rate limits, security controls, or other protective measures;
- probe, scan, or test Dwellera systems without authorization;
- disrupt or materially interfere with the operation of the service;
- impersonate another person;
- use the service for fraud, abuse, harassment, or other unlawful activity; or
- assist another person in doing any of these things.
Dwellera may take reasonable action to protect the service, its users, or others from suspected misuse, security threats, or unlawful activity.
7. Accuracy of user-provided information
Dwellera is primarily a user-managed recordkeeping service.
Dwellera generally does not independently verify information entered or uploaded by users.
This may include:
- property information;
- system and appliance information;
- manufacturer information;
- model and serial numbers;
- purchase or installation dates;
- warranty information;
- maintenance and repair history;
- service-provider information;
- reminders;
- notes;
- photographs;
- receipts;
- invoices;
- manuals;
- inspection reports;
- permits; and
- other uploaded documents or records.
You are responsible for reviewing information that is important to you and correcting it when appropriate.
8. Documents, exports, and important records
Dwellera may allow you to store documents and photos and export supported information.
Dwellera should not be treated as the sole repository for original documents or information that is legally, financially, historically, or operationally critical.
You are responsible for maintaining independent copies of important records when appropriate.
An export generated by Dwellera reflects the supported information available to the service at the time the export is created.
Dwellera does not guarantee that an export contains every piece of information associated with your home or account.
Dwellera does not guarantee that an exported record will satisfy any particular legal, regulatory, insurance, tax, warranty, evidentiary, or recordkeeping requirement.
9. Reminders and maintenance information
Dwellera may provide maintenance reminders and related organizational features.
These features are intended to help you organize information and schedules.
They do not guarantee:
- that a maintenance task is required;
- that a reminder date is correct for your particular home or equipment;
- that maintenance has been completed;
- that equipment is operating safely;
- that a home is free from defects or hazards; or
- that following a reminder will prevent damage, injury, failure, or loss.
You remain responsible for evaluating your home, systems, appliances, and maintenance needs and for obtaining qualified professional assistance when appropriate.
10. No professional advice
Dwellera provides organizational and recordkeeping tools.
Dwellera does not provide professional:
- legal advice;
- tax advice;
- financial advice;
- insurance advice;
- engineering advice;
- architectural advice;
- construction advice;
- home-inspection services;
- safety inspections; or
- professional repair or maintenance advice.
Information presented through Dwellera should not be treated as a substitute for advice, inspection, diagnosis, service, or other work performed by a qualified professional.
You are responsible for deciding when professional assistance is appropriate.
11. Third-party services
Dwellera relies on third-party service providers for portions of the service, such as authentication, infrastructure hosting, backup storage, and transactional email delivery.
Where Dwellera directs you to interact directly with a third-party service, your use of that third-party service may also be subject to the provider's own terms and policies.
Dwellera is not responsible for third-party services outside Dwellera's reasonable control.
The Dwellera Privacy Policy describes relevant service-provider data practices in greater detail.
12. Service availability and changes
Dwellera seeks to operate a reliable service, but uninterrupted or error-free availability is not guaranteed.
Dwellera may experience:
- maintenance;
- upgrades;
- software defects;
- hardware failures;
- network failures;
- service-provider outages;
- security events;
- data-recovery operations; or
- other circumstances that affect availability.
Dwellera may modify, suspend, restrict, or discontinue some or all of the service when reasonably necessary.
Where practical, Dwellera may provide notice of material changes or planned service interruptions, but advance notice is not guaranteed.
13. Suspension and termination by Dwellera
Dwellera may restrict, suspend, or terminate access to the service when reasonably necessary because of:
- material violation of these Terms;
- unlawful or abusive activity;
- unauthorized access or attempted unauthorized access;
- security threats;
- conduct that materially interferes with the service;
- risk of harm to Dwellera, its users, or others;
- a valid legal requirement; or
- discontinuation of the service.
Where appropriate and reasonably practical, Dwellera may provide notice or an opportunity to address the issue before termination.
Dwellera may take immediate action when necessary to protect security, users, the service, or others.
14. Account deletion by you
Dwellera provides a supported process for permanently deleting your account.
Permanent account deletion requires recent authentication and explicit confirmation before destructive processing begins.
A completed deletion may remove Dwellera account information, eligible home records, uploaded files, notification information, and the associated authentication identity.
Some limited information may be retained temporarily or for defined periods for security, deletion integrity, disaster recovery, legal obligations, or other purposes described in the Dwellera Privacy Policy.
Because backup systems use finite retention schedules, information deleted from the active service may remain temporarily in historical backups until those backups expire.
For more information about deletion and retention, review the Dwellera Privacy Policy.
15. Disclaimers
To the maximum extent permitted by applicable law, Dwellera is provided on an "as is" and "as available" basis.
Dwellera does not warrant that:
- the service will always be available, uninterrupted, secure, or error-free;
- information entered by users will be accurate or complete;
- reminders or dates will be appropriate for every home, system, or appliance;
- uploaded files will satisfy any particular legal or recordkeeping purpose;
- exports will contain every piece of information a user may consider important;
- defects will always be corrected immediately; or
- use of Dwellera will prevent property damage, equipment failure, financial loss, injury, or other harm.
Nothing in these Terms excludes warranties, rights, or protections that cannot lawfully be excluded.
16. Limitation of liability
To the maximum extent permitted by applicable law, Dwellera will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to the service, including loss of data, loss of use, loss of profits, property damage, or other consequential loss.
Dwellera is not responsible for loss or harm caused by:
- inaccurate or incomplete user-provided information;
- reliance on reminders or user-maintained records;
- failure to maintain independent copies of important documents;
- actions taken by another person whom you authorized to access a home;
- third-party services outside Dwellera's reasonable control; or
- events that Dwellera could not reasonably prevent.
Nothing in these Terms limits liability that cannot lawfully be limited or excluded.
17. Indemnification
To the extent permitted by applicable law, you agree to be responsible for claims, losses, liabilities, damages, and reasonable costs arising from:
- your unlawful use of Dwellera;
- content you provide in violation of another person's rights;
- unauthorized access you intentionally cause or facilitate;
- your material violation of these Terms; or
- your fraud or intentional misconduct.
This section does not require you to indemnify Dwellera for losses caused by Dwellera's own conduct where such indemnification would be prohibited by applicable law.
18. Privacy
The Dwellera Privacy Policy explains how Dwellera collects, uses, shares, retains, protects, exports, and deletes information.
The Privacy Policy is incorporated into these Terms by reference where legally applicable.
If these Terms and the Privacy Policy appear inconsistent regarding Dwellera's handling of personal information, the Privacy Policy controls with respect to those data-handling practices.
19. Changes to these Terms
Dwellera may update these Terms when the service, business, legal requirements, or other relevant circumstances change.
The effective date at the top of these Terms will be updated when revised Terms become effective.
When appropriate, Dwellera may provide additional notice of material changes through the service or another reasonable communication method.
When required by applicable law or appropriate because of the nature of a material change, Dwellera may require you to review and affirmatively accept revised Terms before continuing to use the service.
20. Governing law and disputes
21. Severability
If a provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
Any invalid or unenforceable provision should be interpreted or limited to the minimum extent necessary to make it valid and enforceable where permitted.
22. No waiver
If Dwellera does not immediately enforce a provision of these Terms, that does not waive Dwellera's right to enforce it later.
A waiver of one provision or violation does not constitute a waiver of any other provision or violation.
23. Entire agreement
These Terms, together with the Dwellera Privacy Policy and any additional terms expressly presented for a particular Dwellera feature, constitute the agreement governing your use of the service.
They supersede prior discussions or understandings concerning the same subject matter to the extent permitted by applicable law.
